Effective Upon Download or Use

By accessing, downloading, modifying, or distributing Starcat Aperion (the “System”), you acknowledge that you have read, understood, and agreed to be bound by the terms outlined in this Agreement.

1. Ownership & Original Work

Starcat Aperion is the original intellectual creation of its creator.
All foundational systems, structures, and identifying elements remain the sole property of the original creator.

This Agreement grants limited rights of use, not ownership.

2. Permitted Use

You are granted permission to:

• Use the System for personal or collaborative purposes

• Modify, expand, or adapt the System

• Share your iterations with others

All permitted use is subject to full compliance with the terms of this Agreement.

3. Required Naming Convention

To preserve the identity and lineage of the System, all modified or derivative versions must follow this naming structure:

Starcat_Aperion_[YourUniqueName]

The terms “Starcat” and “Aperion” must remain intact and clearly visible in the title of all versions, distributions, or references.

Removal, alteration, or concealment of this naming structure is strictly prohibited.

4. Attribution Requirement

All uses, distributions, and derivative works must provide clear and visible credit to the original creator of Starcat Aperion ([Starcat-Studios]K7NE).

You may not claim authorship of the original System, nor present it in a way that implies it is entirely your own creation.

5. Non-Commercial Use

Starcat Aperion is provided as a free system for public use.

You are strictly prohibited from:

• Selling the System in any form

• Selling modified or derivative versions

• Restricting access behind payment, subscriptions, or monetized platforms

Any attempt to commercially exploit the System or its derivatives is a direct violation of this Agreement.

6. Identity & Integrity of the System

You may not:

• Rebrand the System as a separate or unrelated product

• Remove references to its origin or identity

• Present a derivative version in a way that obscures its connection to Starcat Aperion

All versions must remain recognizably part of the Starcat Aperion framework.

7. Redistribution

Redistribution of the System or its modified versions is permitted, provided that:

• This Agreement is included with the distribution

• All terms within this Agreement are upheld in full

8. Termination of Rights

Failure to comply with any part of this Agreement will result in immediate termination of your rights to use, modify, or distribute the System.

Upon termination, you are expected to cease all use and distribution of Starcat Aperion and any related derivatives.

9. No Warranty

The System is provided “as is,” without warranty of any kind, express or implied. The creator is not liable for any damages, issues, or outcomes resulting from its use.

10. Acceptance of Terms

By proceeding with download, installation, or use of Starcat Aperion, you confirm your acceptance of this Agreement in its entirety.

If you do not agree with these terms, you must not use or distribute the System.

Starcat Aperion is intended to remain free, evolving, and connected—built upon shared creativity while preserving its original identity.

11. Enforcement, Damages, and Legal Remedies

Any unauthorized use, distribution, or commercial exploitation of Starcat Aperion, including violations of the terms outlined in this Agreement, shall constitute a breach of this license and an infringement of the creator’s rights.

In the event of such a breach:

• Immediate Termination
  All rights granted under this Agreement will terminate automatically upon violation.

• Injunctive Relief
  The creator reserves the right to seek immediate legal action to prevent continued misuse, including injunctive or equitable relief without the requirement to post bond where permitted by law.

• Liquidated Damages
  You acknowledge that unauthorized use, particularly commercial use or misrepresentation, may result in measurable harm that is difficult to quantify.
  As such, you agree that damages may be assessed based on a reasonable estimate of harm, including but not limited to reputational damage, loss of control over the System, and unauthorized monetization.

• Recovery of Legal Fees
  In the event that enforcement action is required, you agree that the prevailing party shall be entitled to recover reasonable legal fees, costs, and expenses associated with such action, where permitted by applicable law.

• Unauthorized Commercial Use
  Any attempt to sell, monetize, or commercially distribute Starcat Aperion or its derivatives without explicit written permission shall be considered unauthorized use and may be pursued to the fullest extent permitted by law.

This section is intended to protect the integrity, identity, and free accessibility of Starcat Aperion and to discourage misuse or exploitation.

12. Verification & Recognition

Starcat Aperion may include a “Verified” or “Recognized” status to identify builds that comply fully with this Agreement.

Only versions that adhere to all naming, attribution, and non-commercial requirements may be considered verified or recognized within the Starcat Aperion ecosystem.

Any version that fails to meet these requirements may be publicly identified as unverified and non-compliant.

Verification status is determined solely by adherence to this Agreement and may be granted or revoked at any time.
